bubbltag
Effective date 16 September 2026 | Last updated 14 October 2026
These Terms of Service (the "Terms") govern your access to and use of the bubbltag app, associated services and event-registration pages in the United Kingdom, the European Economic Area and the United States, including authorised event-hosting activities and purchases. Section 16A sets out additional terms for residents of the United States, and section 16B sets out additional terms for residents of the European Economic Area.
You are responsible for your own content, conduct and dealings with other people, both in the app and outside it. Responsibility for a user's wrongdoing does not pass to bubbltag, its personnel, or any host, partner, business or venue merely because it provided the platform, an event or premises. Sections 12 and 13 set out the protections given to those parties and the legal limits on them. Your mandatory consumer and data protection rights are not affected.
Your agreement is with bubbltag UK Ltd, company number 16907701, whose registered office is 9th Floor, 107 Cheapside, London, EC2V 6DN, United Kingdom, wherever you use the service. Unless stated otherwise, "bubbltag", "we", "us" and "our" mean that company. Contact: support@bubbltag.com.
Our parent company, Bubbltag, Inc., is incorporated in Delaware, United States, and its correspondence address is 2261 Market Street STE 46278, San Francisco, CA 94114, United States. That company and the personnel identified in section 12 have the benefit of the protections expressly given by these Terms. They do not become personal guarantors or contracting suppliers merely because they own, or work for, the group. Bubbltag, Inc. publishes the bubbltag app in the Apple App Store and on Google Play; your agreement remains with bubbltag UK Ltd.
These Terms take effect when you affirmatively accept them. Hosting, including business hosting, is governed by these same Terms, in particular sections 6A and 6B. Hosts accept these Terms and acknowledge receipt of the Privacy Policy; no separate bubbltag hosting agreement is required. Event-specific conditions and transaction details must be disclosed before the relevant commitment is made. Unless bubbltag is expressly identified as organiser, the identified independent host is the supplier of the event. Mandatory law prevails, and no general provision introduced later removes a right that has already accrued.
The Privacy Policy explains how we process personal information. Accepting these Terms is not consent to biometric processing, optional location access, AI processing or marketing where the law requires separate consent.
You must be at least 13 years old to use bubbltag, and you must state your age truthfully when you register. If you state an age under 13, registration stops. A person under 13 may not use the service, even with a parent's permission. Age is self-declared; facial checks do not verify age or legal identity. Misrepresentation of age, whether upwards or downwards, impersonation and circumvention of eligibility criteria are prohibited.
If you live in a European Economic Area country whose law sets a higher age for consenting to the use of personal information (between 13 and 16, depending on the country), you must have reached that age. By registering, you confirm that you meet the age that applies where you live. You are responsible for knowing what that age is.
bubbltag is not directed to anyone under 13, and we do not knowingly allow them to register.
The registration, profile, payment and support details you give must be accurate and not misleading. You must use your own account and photograph, correct inaccuracies promptly, keep your device and sign-in codes secure, and report any suspected compromise. You may not hold more than one active account, share, sell, transfer or lend an account, or obtain access on behalf of a restricted person.
For members aged 13 to 17, these Terms apply subject to the legal protections given to children and the rules on contractual capacity. You must obtain any permission the law requires for a purchase or activity, and you must be lawfully entitled to use the payment method concerned or to take on a hosting obligation. Your acceptance does not, by itself, bind a parent or guardian or make that person liable for your debts or conduct.
Suspected ineligible access may be restricted and an ineligible account closed. To the extent permitted by law, you remain accountable for deliberate false declarations and circumvention. The Protected Parties are not liable for loss arising solely from a deliberate misrepresentation of age where they have met their own duties and are not otherwise legally responsible. Nothing in these Terms waives a child's rights or displaces any mandatory child-safety, age-assurance, data protection or other duty. A false statement of age does not, by itself, authorise three-year retention of a child's biometric information.
Facial matching and liveness checks are carried out by Veriff. No identity document is collected or examined for registration, later sign-ins on a phone, profile-photograph changes or account deletion. These checks do not verify or estimate age and do not establish legal identity. You must provide a genuine photograph of yourself and cooperate with lawful account checks. Manipulated images, artificial likenesses and interference with verification are prohibited.
Before any biometric information is collected, a facial check through Veriff requires your separate, valid and explicit consent, as described in the Privacy Policy. Submitting a selfie or accepting these Terms is not that consent. Registration, later sign-ins on a phone and profile-photograph changes require that consent and a successful check; if you decline, they cannot be completed. Continued use of an account requires facial verification; an account cannot continue to be used with verification switched off. To withdraw biometric consent, request account deletion through the app under section 11. This requirement is subject to applicable law and does not reduce the statutory rights described in the Privacy Policy. Access may be restricted in response to failed, disputed or apparently fraudulent results. An explanation and human review may be requested at support@bubbltag.com.
A successful check is not a background, criminal-record, character or safety assessment, and it is not an endorsement or an assurance that the person now using the account is the person originally checked. The Privacy Policy governs biometric purposes, Veriff retention and withdrawal rights, none of which is waived by these Terms.
Proximity, attendance, profile and other user information may be incomplete, inaccurate or delayed. We do not promise any social outcome, uninterrupted availability or that every nearby user will be identified. This is subject to our obligations in section 12.
You are responsible for choosing what you share and with whom. Privacy settings do not work retrospectively: they cannot recall what has already been shared or copies held by the people who received it. Material exceptions to ordinary disclosure settings, including safety-related disclosure of photographs and access by event personnel and group members, are described in the Privacy Policy. Blocking and reporting cannot guarantee that contact or misconduct is prevented, particularly outside the service.
Objectionable content and abusive users are not tolerated. Content that breaches this section may be removed or restricted, and the accounts responsible may be restricted, deactivated or banned, under sections 9 and 10.
You agree to use bubbltag lawfully and respectfully. You are personally responsible, and liable as the law provides, for your acts, omissions, statements and content, including messages, photographs, recordings, posts, event contributions and AI-assisted material that you choose to send or publish. These obligations cover how you treat users and other people in the app, in private arrangements, at meetings, events and venues, and in related communications before or afterwards, including on other services.
You must respect consent, personal boundaries and lawful instructions. You remain liable for such loss or injury as the law attributes to your harassment, threats, assault, fraud, privacy infringements, property damage or other wrongful conduct. That liability does not pass to the platform, its personnel, or a partner, host, business or venue merely because it enabled the contact or provided the setting. Simply choosing to communicate or attend does not make you liable for another person's wrongdoing. Sections 12 and 13 preserve each person's own duties and deal with claims caused by your conduct.
You must not:
A report made in good faith is not prohibited merely because it turns out to be unsubstantiated. Honest complaints, lawful disclosures to competent authorities and the exercise of legal rights remain protected. A report should distinguish what was observed from what is suspected.
You must hold every right and permission needed to upload photographs, recordings, files and personal information about other people. Access to a conversation does not, by itself, give authority to publish its contents. Unnecessary exposure of another person's sensitive information is prohibited. These obligations apply equally to material that AI suggests or rewrites and that you choose to send or publish.
You use bubbltag, meet other people and attend events at your own risk. The decision to communicate with, meet or attend is yours alone, and you are solely responsible for your own safety, decisions and dealings with other people. bubbltag does not conduct background checks, criminal-record searches or identity-document checks. To the fullest extent permitted by the law where you live, you accept the risks of meeting people you first encountered through bubbltag.
In making those decisions, you must respect consent, boundaries, lawful venue rules and the safety of others. A profile, facial-check result, recommendation or safety notification is not evidence of another person's intentions or safety. Safety and reporting tools cannot predict or prevent every incident and are not emergency services. In immediate danger, contact the emergency services.
Unless expressly designated as organiser, bubbltag neither organises nor supervises private user arrangements or independent events. Providing an app, promotion, event, premises, admission or hospitality does not, by itself, make a Protected Party responsible for an independent user's conduct. This applies before, during and after an interaction or venue visit, whether or not the venue has a commercial relationship with bubbltag. Each person remains responsible for their own duties and conduct under section 12.
The independent host is the supplier of its event and is responsible for it. A listing, facial check, pass or Founding Host status does not mean that bubbltag has inspected or approved the organiser, the premises or the activity. Where bubbltag is expressly the organiser of an event, it has the duties of an organiser.
A host must have an eligible account, legal capacity and authority, the necessary venue and content permissions, and all required licences and insurance. A host must identify the actual organiser and whether it is a trader, provide the required business and contact details, and accurately disclose descriptions, dates, prices, admission conditions, accessibility information and material risks. Hosts are responsible for appropriate risk assessment, reasonable safety arrangements, lawful capacity and their authorised teams. A person who hosts for a business or other organisation confirms that they are authorised to accept these Terms for its hosting. Through that authorised acceptance the identified organiser is bound by the hosting obligations; the individual remains responsible for their own account and conduct.
A request for a place, or a place on a waiting list, is not a confirmed place. Passes are personal and must not be shared, sold or transferred without authority. Registration codes and passes must be kept secure. Guests must meet the disclosed admission conditions and follow lawful and proportionate safety instructions. Hosts must not discriminate unlawfully, impose material undisclosed conditions after payment, or refuse admission in order to avoid a refund that is due.
The platform minimum age is 13; a higher lawful minimum may be imposed by an event or venue, provided it is disclosed before booking. Responsibility for required age checks, safeguarding and lawful admission remains with the host. An age stated in the app, a facial-check result or a pass is not proof of age and does not satisfy those duties.
Hosts and their teams must use guest information only for legitimate event purposes, restrict access to it and comply with applicable privacy obligations. Profile harvesting, creation of facial databases and unrelated marketing are prohibited. Registration questions must be necessary and lawful; sensitive information requires the applicable additional legal condition and separate consent. Personal or confidential information must not be published without a proper basis. The Privacy Policy explains event disclosures and public information; the liability protections give no additional right of access to personal data.
A host may set event-specific conditions for attendees, provided they are lawful, fair and available before an attendee commits. Those conditions are not a separate hosting agreement with bubbltag. Hosts must promptly communicate cancellations, material changes and safety information, and provide the remedies that are due. Cancelling an event or deleting an account does not end obligations owed to guests. Optional marketing requires the applicable separate consent and unsubscribe facilities.
Each participant remains responsible for their own acts and omissions and for the liability that follows from them. The Protected Parties, including bubbltag and its personnel, independent hosts and their teams, partners, businesses, venue operators and venue personnel, are neither insurers nor guarantors against accidents, illness, theft, harassment, assault or other misconduct. They are not liable for loss caused solely by an independent user's wrongdoing where they have not breached a duty and are not otherwise legally responsible. Hosting, promoting, admitting or providing premises does not, by itself, transfer that responsibility.
This allocation covers preparation, travel, attendance, departure, after-parties and later contact, on or off the platform. The exclusions and limitations in section 12 apply, including the preservation of liability for a person's own actionable conduct and every liability which cannot lawfully be excluded. Taking part is not consent to negligence and does not waive statutory rights. The Protected Parties may enforce the benefits expressly given to them, as section 16 provides.
The following provisions apply to paid event tickets offered through bubbltag. The listing and checkout must identify the supplier and whether it is a trader, the event date and ticket, the total price including mandatory charges and taxes, any approval condition, the refund terms and the payment provider. Any role bubbltag has in collecting or settling payments must be expressly disclosed. The host's obligations as event supplier remain distinct from bubbltag's platform obligations.
Each host chooses pounds sterling, euros or US dollars as the event currency. Tickets, booking fees and Chip in amounts are priced, and host proceeds are paid, in that currency. A host may sell in the currency of its payout account's country, and in another of those three currencies once a bank account in that currency has been added to the payout account. A host whose payout account is in the United States sells in US dollars. A buyer whose card is in a different currency still pays in the event currency, and the card provider may charge for conversion.
100% of the ticket price set by the host, actually paid by the attendee and successfully settled, is paid directly to the host. bubbltag does not charge a host any commission, platform fee or payment-processing charge, and deducts none from that ticket price. This entitlement applies to completed sales subject to refunds, reversals and lawful dispute or verification holds, which are adjustments rather than additional fees. Hosts remain responsible for their own taxation. The timing of payouts follows the disclosed settlement arrangements.
For tickets sold by a host other than a Founding Host, the attendee pays bubbltag a booking fee in addition to the host's ticket price, as follows: for sterling tickets, 3.3% of the ticket price plus 21p; for euro tickets, 3.3% plus €0.26; and for US-dollar tickets, 4.7% plus US$0.32. Each amount is rounded up to the nearest penny or cent. The fee is part of the total price shown before booking and at checkout, is the same for every payment method, and is refunded in full whenever the ticket is refunded. bubbltag bears ticket payment-processing costs in every case, including Founding Host tickets. We may change booking fees on reasonable advance notice for events created after the change takes effect, but not for tickets already on sale.
A host organising an event in their personal capacity sells their tickets and Chip in as a private individual. Where the payout account belongs to another person, including a parent, that account holder is the seller, whose first name is shown to buyers before payment. A host who sells in the course of a trade or business must host through the relevant organisation, which is the business seller.
A host may allow attendees to choose to pay an additional amount for their place, called "Chip in", whether the event is free or paid. The amount is part of the price the attendee chooses to pay for their place; it is not a donation or a charitable gift and attracts no tax relief. bubbltag keeps none of it. The payment provider's actual processing charge is deducted before the amount is paid to the host, and depends on the card, the currency and the country of the host's payout account. For a United Kingdom host, a sterling event and a standard UK card, the charge is 1.5% of the amount, plus 20p where the payment is a separate transaction for a free place; other cards, currencies and countries incur higher charges. Before paying, the attendee is shown the least the host will receive and, where the event currency is that of the host's own country, what the host will receive from a standard domestic card. The exact amount is disclosed after payment. bubbltag bears no part of that charge. For a paid event, Chip in is refunded whenever the ticket is refunded. For a free event, it is refunded if the host cancels, if the host removes the attendee, or if the attendee gives up their place before the event starts. The attendee may choose whether the host is told their first name with the amount. This does not change the host's ticket price or the provisions above.
A Founding Host is a host whom bubbltag has designated as one, including by redeeming a founding host code that bubbltag issued to that host. A Founding Host's attendees never pay a booking fee on top of the ticket price, whatever later changes bubbltag makes to its prices. Any organisation of which a Founding Host is, or later becomes, an administrator on bubbltag has the same Founding status, and keeps it after that person leaves or hands over. The provision above allowing changes to booking fees does not apply to this Founding arrangement.
A host may act for a club, company, charity or other organisation where duly authorised. The organisation, as verified by the payment provider, is the seller and recipient of ticket proceeds; its current administrators and organisers administer its events through bubbltag. An individual's access through bubbltag to the organisation's events, guests and payouts ends when their role ends. Access given directly by the payment provider remains governed by that provider's terms.
Hosts must disclose a fair refund policy before booking and arrange every refund that is due. If the host cancels, the guest is entitled to a refund of the ticket price and the mandatory charges for the cancelled event. A material change, or a failure to provide the event, gives the guest the applicable rights to reject the change, receive a refund or pursue another remedy. No "no refunds" term, cancelled pass, deleted account or limitation of liability overrides mandatory rights. Otherwise, voluntary cancellation and non-attendance are governed by the disclosed policy and applicable law. bubbltag remains responsible for remedies which the law requires it to provide. Refunds are made in the ticket currency; where the buyer's card is in a different currency, the amount credited depends on the card provider's exchange rate on the refund date.
The ordinary UK 14-day right to change your mind may not apply to a qualifying leisure activity provided on a specific date or during a specific period. Any exception that applies must be explained before purchase, and does not remove remedies for cancellation or for an event that is not provided.
Hosts remain liable for established refunds and reversals and must not withdraw funds needed to meet them. Any recovery must be supported by the transaction details, and the host must have a reasonable opportunity to contest an error. Neither automatic forfeiture of all proceeds nor double recovery is permitted. Fraudulent chargebacks, fictitious bookings and manipulating eligibility for fees are prohibited; genuine disputes and statutory remedies remain available.
You retain ownership of the content you submit. You grant bubbltag a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, transmit, display and technically adapt that content, but only so far as reasonably necessary to deliver the features you request, implement your audience selections, provide permitted AI assistance, moderate misuse, secure the service and comply with law. The licence does not cover unrelated commercial exploitation.
Our contracted providers may use that licence only for the relevant service purpose. It lasts only as long as needed for those purposes and for limited lawful retention after deletion. The licence is subject to the Privacy Policy, applicable consent requirements and third-party rights. It gives no right to train general-purpose models on private content or to use private content for advertising.
The access other users receive depends on the feature and the audience you choose, and gives them no unrestricted right to publish, sell or exploit your content. We cannot guarantee that recipients will comply or that copies can be retrieved. Suspected misuse should be reported to us.
All rights in the app, software, design, branding, trade marks and service materials are owned by or licensed to the relevant bubbltag company. Subject to compliance with these Terms, you are granted a limited, personal, non-exclusive and non-transferable right to use the app on compatible devices for permitted purposes. You acquire no ownership interest in our technology or intellectual property. You must not imply that you represent bubbltag, or use its branding, without permission.
Suggestions may be submitted voluntarily. We may use non-confidential product feedback without payment; submitting it gives us no unrestricted rights in personal information, private content or material separately identified as confidential.
AI-generated advice, assessments and content may be inaccurate, incomplete, biased or inappropriate. AI output is not a reliable indication of another person's intentions, consent, identity or safety, and is not professional, medical, legal or emergency advice.
You must review AI output before you rely on it, send it or publish it. Subject to section 12, you remain responsible for your decisions and for unlawful or harmful content that you knowingly or carelessly adopt. We do not guarantee any social, personal or commercial outcome. AI output may resemble material given to other people and may not qualify for exclusive intellectual property protection; you must not claim rights you do not have.
AI processing, permissions, retained conversations and temporary processing are governed by the Privacy Policy. How an external recipient handles information it receives is governed by its own terms and duties; that does not remove our responsibility for our own disclosure.
An account, event, host, team member or item of content may be reported through the app or to reportaproblem@bubbltag.com. A report should identify what or whom it concerns, explain the concern, and include relevant evidence that the person reporting is entitled to share. You do not need to identify the exact law that may have been broken. Reports are reviewed by appropriate personnel and technical means, and proportionate measures are taken.
Measures may include removing or restricting listings or other content, limiting features, warnings, additional verification, temporary restrictions on access, deactivation, a ban on use or re-registration for up to three years under section 10, a permanent ban for the most serious breaches under section 10, or a lawful referral to the competent authorities. Severity, credibility, context, repetition, immediate risk and applicable law inform the decision. We do not promise to review every communication in advance or to ensure that no prohibited content ever appears.
Where lawful and appropriate, we give the affected person the reasons for a restriction and a way to seek review. We may withhold details to protect a person who reported, to preserve an investigation, to comply with the law or to avoid revealing security information that could be exploited. Reports are handled confidentially within the review process, but we cannot guarantee absolute secrecy from recipients the law authorises, or that nobody will infer who reported from the surrounding events.
Complaints concerning moderation, erroneous removal, suspension, reporting procedures or performance of safety duties may be submitted to support@bubbltag.com, identifying the contested decision or issue and the grounds of challenge. A person with authority to reconsider the matter will review the challenge and may reverse the decision. You do not need to be signed in to complain. We do not retaliate against complaints or reports made in good faith.
Privacy complaints are governed by the Privacy Policy. Other complaints are considered within a reasonable period, with updates appropriate to the circumstances. Where the law requires it for an unresolved dispute, we will tell you about an appropriate alternative dispute resolution provider and whether we are obliged or willing to use it. Your access to the courts and to regulators is not affected.
Reports and blocks from different accounts may lead to warnings and to automatic deactivation pending review. Numerical thresholds do not establish wrongdoing. A credible serious concern may warrant immediate protective measures without prior warning. False, coordinated or mistaken reports are assessed for what they are; a report is not treated as proof of misconduct merely because it was made.
Before any ban is confirmed, a human reviewer assesses the account and the supporting evidence. Both the finding and the length of the ban must be supported by evidence. The reviewer considers seriousness, harm or risk, context and your response; where a child is concerned, the reviewer also considers the child's age, understanding and best interests, and proportionality. We give you the reasons, the start and expiry dates and a route to review, subject to lawful confidentiality limits.
Deactivation, the substantive finding and the duration may be challenged at support@bubbltag.com with relevant supporting information. A reviewer may reverse or shorten a restriction and correct related records. You do not need an active account, or to give further biometric consent, to obtain a review.
During a valid ban, you must not obtain or operate another account, whether yourself or through someone else. Deleting the account does not, by itself, end the restriction. The period runs from the first deactivation for the matter concerned, including any unbroken provisional restriction, and, except for a permanent ban, never exceeds three years. An attempt to re-register does not restart that period. After a ban expires or is lifted, you may apply again under the eligibility rules then in force; the former account and its history are not automatically restored.
Permanent bans. For the most serious breaches, such as child sexual abuse or exploitation, trafficking, or credible threats of serious violence, a human reviewer may ban an account permanently. The same review, reasons and route to review apply. The former account is never restored, and you must never obtain or operate another account, whether yourself or through someone else. Facial records used to prevent re-registration are still kept for no more than three years, as the Privacy Policy explains. After that, an account found to belong to a permanently banned person may be closed.
During an active ban, Veriff retains facial verification and biometric records, linked account references and restriction dates, for prevention of re-registration, subject to the three-year maximum. bubbltag does not store verification selfies or biometric templates. The Privacy Policy governs individual face-check retention and deletion. Retention and matching require continuing necessity, a lawful basis, a special-category condition and the safeguards set out in that Policy. Records are taken out of active matching and deleted when the ban expires or is lifted, or at any earlier deletion deadline that applies. Backup retention or a legal hold does not authorise matching against an expired ban.
Accepting these Terms is not biometric consent and does not waive your rights of erasure, objection, withdrawal or review. Where consent is the sole valid basis, its withdrawal terminates the relevant biometric processing without automatically cancelling a separately valid account restriction. Biometric records are not given to hosts or venues and are not used to build a blacklist for unrelated services.
You may stop using bubbltag and request deletion of your account at any time. To withdraw biometric consent, request account deletion through the app; this is subject to proportionate authentication and applicable law. Closure does not automatically resolve outstanding refund or payment disputes. The Privacy Policy specifies deletion of Veriff-held records, other retention and statutory withdrawal rights. Processing that depends on consent stops when the consent is withdrawn, without waiting for deletion to be completed.
Access may be suspended or terminated for material breach, ineligibility, an unresolved verification concern, a credible safety or security risk, unlawful use, an applicable legal obligation or withdrawal of the service. Any such action must be reasonable and proportionate. Where appropriate, we give notice and an opportunity to put right a breach that can be remedied; urgent protection or a legal prohibition may require immediate action. The review rights in sections 9 and 10 remain available.
If a paid service is permanently discontinued, or ended for reasons unrelated to a breach by you, we refund the appropriate unused prepaid portion. During a disputed suspension, we preserve the paid entitlements affected until the review is complete, or provide an appropriate remedy. Termination for breach does not mean that all prepaid value is automatically forfeited: any deduction must be lawful, proportionate and explained, and sums otherwise due are refunded.
Reasonable amendments may be made for security, legal compliance, compatibility, reliability or service development. For a change to a paid service that is materially to your disadvantage, we give appropriate notice and any opportunity the law requires to end the service and receive a proportionate refund. Justified urgent amendments may take effect earlier, with notice as soon as reasonably practicable. Experimental or free features may be retired on reasonable notice, subject to specific commitments and mandatory rights.
Material changes remain subject to the applicable notice, acceptance and privacy requirements.
For the purposes of these Terms, "Protected Parties" means:
These descriptions identify who benefits from the protections; premises do not become a bubbltag partner merely because a user is present there. A user who is also a host, partner or member of staff remains responsible for their own wrongful conduct. Being a Protected Party does not, by itself, create joint liability, a partnership, an agency or a guarantee of another Protected Party's performance; a Protected Party is liable only where there is an independent legal basis.
Every user is responsible for their own content, behaviour and dealings. No Protected Party is liable for loss or injury caused solely by an independent user's acts or omissions where that Protected Party has not breached a duty and is not otherwise legally responsible for that loss. This covers disputes, misleading statements, fraud, harassment, stalking, threats, assault, discrimination, misuse of private information and damage to property caused by that user.
Liability does not arise merely because contact originated through bubbltag, a facial check or admission criterion was satisfied, an event was hosted or promoted, or the people concerned attended the same venue. This allocation applies to app content and messages, group activities, offline meetings and later contact, before, during and after an event or venue visit. No Protected Party insures or guarantees the conduct of independent users. Using the app or attending an event does not, by itself, make a user an employee or agent of a Protected Party.
Nothing in these Terms excludes a Protected Party's responsibility for its own acts or omissions, breach of contract, negligence or failure to meet a duty of care that applies to it, or for people for whom it is legally responsible. Organiser safety duties, occupier obligations and bubbltag's applicable platform, moderation, consumer and data protection duties remain enforceable. A party cannot avoid liability for failing to take action the law requires merely by pointing to another user as the immediate wrongdoer. Hacking, a failure by a provider and misuse of disclosed information are assessed in the same way, by who is actually legally responsible.
To the extent permitted by law, where a Protected Party voluntarily helps, investigates, moderates, checks admission or offers a goodwill gesture, that is not, by itself, an admission of liability, an endorsement of any participant, or an agreement to take on responsibilities that belong to somebody else. None of this reduces a duty that a party has actually taken on or that the law imposes. No host or other Protected Party guarantees any level of attendance, that people will get on, or any social or commercial outcome, unless it has expressly and lawfully promised this as part of what it supplies.
We supply our services with the reasonable care and skill, and our digital content with the quality, fitness for purpose and match to its description, that applicable law requires. Where we breach these Terms, we are responsible for loss and damage foreseeably resulting from that breach or failure to exercise reasonable care and skill. Loss is foreseeable if it is an obvious consequence of the breach, or if you and we could reasonably have contemplated it when the contract was made.
We do not guarantee uninterrupted or error-free operation, perfect verification, exact proximity, complete security or the prevention of all misconduct. These practical limits do not excuse a breach of our own duties. Safety tools and reporting channels do not guarantee detection or prevention of every incident.
The ordinary consumer service is supplied for personal use; the event provisions permit expressly authorised hosting. To the extent permitted by law, we are not liable under the consumer agreement for business losses arising from commercial use outside the agreed purpose. Authorised business-hosting claims remain governed by these Terms, including sections 6A and 6B, and applicable law; the personal-use limitation does not extinguish those rights. We are not responsible for loss that was not foreseeable, loss caused by your own unlawful acts, or loss caused solely by matters beyond our reasonable control where we have met our own duties. We remain responsible for taking the reasonable steps required to limit interruption or loss.
Subject to the next paragraph, the total liability of bubbltag UK Ltd and Bubbltag, Inc. to you for all claims arising in any 12-month period is limited to the greater of £100 and the total you paid to bubbltag in that period, excluding sums paid to a host.
Nothing in these Terms excludes or limits any person's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for a statutory right or remedy that cannot lawfully be excluded, or for any other liability that applicable law does not allow to be excluded or limited. Mandatory consumer rights, data protection rights and regulatory duties are expressly preserved.
Your contractual right to the app service is against bubbltag UK Ltd. Neither its parent nor the identified personnel provide a personal guarantee merely through ownership or employment. For what they do in the course of their work, they may rely on the protections and defences in these Terms, subject to the same exceptions. A venue, business or host does not become the contractual provider of the app because it is associated with the service; its own obligations for its events, premises, goods and services still apply.
This allocation applies to claims in contract, negligence and other civil claims only so far as it is valid for the particular claim. It does not prevent anyone from reporting an incident, seeking emergency help, complaining to a regulator or bringing proceedings against a person who is legally responsible. Except as section 16A expressly provides where it lawfully applies, accepting these Terms, attending a venue or taking part in an event does not release unknown claims. Identified third parties may enforce their express benefits under section 16, subject to the same limitations and defences.
You are responsible for reasonably foreseeable loss and damage directly caused by false identity or age details, deliberate circumvention, harassment, abuse, other unlawful conduct or a material breach of these Terms, where you are legally responsible for it. This covers your conduct in the app and at related meetings, events and venues, and in later contact. A Protected Party does not take over that responsibility by providing the platform, hosting, promotion or premises.
If your conduct leads a third party to claim against a Protected Party, you must reimburse and indemnify that Protected Party, but only for reasonable losses, damages and legal costs that are legally recoverable from you, directly caused by that conduct and reasonably foreseeable. The party claiming must prove both that you are responsible and the amount. Nothing is due for the Protected Party's own breach, negligence, wilful misconduct or failure to meet its duties, for its responsibility for another person, or for any fine or cost that cannot lawfully be passed on. Where multiple causes contribute, recovery is confined to the amount properly attributable to your conduct. This does not oblige you to fund every defence automatically or to pay on every allegation.
A Protected Party seeking reimbursement must give you reasonable notice and supporting details, take reasonable steps to limit the loss, and give you a fair opportunity to respond. No settlement that commits you to an admission, a non-monetary obligation or a payment may be agreed without your consent, unless the obligation arises from a binding legal decision. You may contest both liability and the amount. Penalties, unreasonable costs and double recovery, including recovery of the same loss directly and through another Protected Party, are prohibited.
This section is subject to applicable consumer law, children's contractual capacity and liability rules, and section 12. It does not impose an unenforceable reimbursement obligation on a child, or make a parent liable without a separate lawful basis. It does not penalise a complaint made in good faith, an honest but unsuccessful report, the exercise of privacy rights or a refusal of optional processing. A victim does not become responsible for another person's misconduct.
You must meet the device and operating-system requirements stated for the app. Network charges for data or messages are governed by your provider's agreement. External links, wallets, venues, organisers and AI services may have their own terms, which you should read when you choose to use them.
Where the app is downloaded through Apple, the contracting party remains bubbltag UK Ltd. We, not Apple, are responsible for the app and its content, for support, for applicable warranties and for product, regulatory, consumer and privacy claims. We are responsible for investigating, defending, settling and discharging intellectual property claims about the app or its use. Apple has no obligation to provide support.
The non-transferable licence extends to Apple devices owned or controlled by you and applicable Family Sharing or volume-purchase access, subject to Apple's Media Services Usage Rules, which prevail over inconsistent app-use provisions.
If the app fails to meet an applicable warranty, you may notify Apple, which will refund any purchase price paid for the app. To the extent permitted by law, Apple has no further warranty obligation; remaining warranty losses and remedies are our responsibility.
You confirm that you are not located in a country that is subject to a US embargo or that the United States has designated as supporting terrorism, and that you are not on a US prohibited-party list. You must comply with applicable third-party agreements, including your network agreement.
Once you accept these Terms, Apple and its subsidiaries may enforce these app-related provisions as beneficiaries. Our contact details appear in section 17. Mandatory rights are unaffected.
Google Play and other authorised stores may set their own distribution and billing conditions, which do not displace mandatory rights.
These Terms may be amended to reflect changes in law, security, service operation or products. We notify material changes in advance, with the date they take effect, and ask you to accept again where required. No change alters, after the event, the basis of a claim that has accrued, a past purchase or a completed transaction.
If you decline a material amendment, you may discontinue the affected service and exercise applicable cancellation and refund rights. Changes urgently required by law or by an immediate security risk may take effect sooner, with appropriate notice. Any new privacy consent is obtained separately.
These Terms and connected non-contractual disputes are governed by the law of England and Wales, subject to applicable mandatory protections. Proceedings may be brought in the courts of England and Wales. Consumers retain any entitlement to proceedings in their home jurisdiction, including Scotland or Northern Ireland. We may bring proceedings against a consumer only in a court that applicable law permits. Sections 16A and 16B modify this provision for residents of the United States and European Economic Area respectively.
A provision that is unlawful or unenforceable is ineffective only to that extent; this does not reduce mandatory rights or make an unfair term enforceable. The rest of these Terms continues so far as it can operate fairly. A delay in exercising a right is not a waiver of it. No employment or partnership relationship with a user is created. Independent hosts and their teams do not become bubbltag agents solely through platform use. Any limited payment agency must be expressly agreed in the disclosed payment arrangements.
We may assign or transfer the agreement as part of a genuine reorganisation or business transfer only where your rights are not reduced and your position is not materially worsened, with appropriate notice and remedies where required. You may not transfer an account or contract without our consent except as permitted by law.
Each third party within a class expressly identified as a Protected Party in section 12 may, under the Contracts (Rights of Third Parties) Act 1999, enforce the benefits that sections 2, 6, 6A, 12 and 13 expressly give it, subject to every corresponding limitation, exception and defence. The Apple beneficiaries identified in section 14 may likewise enforce the benefits expressly given there. No other third party has a right under that Act to enforce these Terms. You and we may vary or terminate the agreement without beneficiary consent, subject to accrued rights and mandatory law.
Provisions intended to survive termination do so only so far as necessary, including those on outstanding payments and refunds, limited content retention, lawful claims, protection of personnel and dispute resolution. Account termination neither extends a notified ban beyond its expiry or the three-year maximum nor authorises indefinite processing.
This section applies if you live in the United States. Where it conflicts with another provision, it prevails to the fullest extent permitted by applicable law. Every disclaimer, assumption of risk, release, indemnity, limitation period and procedural waiver in this section is subject to the limits that applicable law does not allow to be excluded.
BUBBLTAG IS SUPPLIED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, THE PROTECTED PARTIES DISCLAIM ALL EXPRESS, IMPLIED AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY, AND ANY WARRANTY OF UNINTERRUPTED, SECURE OR ERROR-FREE SERVICE. BUBBLTAG DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR EXAMINE IDENTITY DOCUMENTS. A FACIAL CHECK DOES NOT VERIFY IDENTITY, AGE, CHARACTER OR INTENTIONS.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU BEAR SOLE RESPONSIBILITY FOR YOUR INTERACTIONS WITH OTHERS, ONLINE AND IN PERSON, AND ASSUME THE RISKS ASSOCIATED WITH USE OF BUBBLTAG, MEETINGS WITH USERS AND EVENT ATTENDANCE, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE AND EMOTIONAL OR FINANCIAL HARM.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE THE PROTECTED PARTIES FROM CLAIMS, DEMANDS AND DAMAGES OF EVERY DESCRIPTION, WHETHER KNOWN OR UNKNOWN, ARISING FROM OR CONNECTED WITH THE CONDUCT OF ANOTHER USER, HOST, VENUE OR OTHER THIRD PARTY, OR WITH AN EVENT. IF YOU RESIDE IN CALIFORNIA, YOU WAIVE, TO THE EXTENT LAWFULLY PERMISSIBLE, CALIFORNIA CIVIL CODE SECTION 1542, WHICH PROVIDES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."
TO THE FULLEST EXTENT PERMITTED BY LAW, NO PROTECTED PARTY SHALL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, LOSS OF PROFITS, DATA OR GOODWILL, OR PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM ANOTHER PERSON'S CONDUCT. THE AGGREGATE LIABILITY OF ALL PROTECTED PARTIES TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF US$100 AND THE SUM PAID BY YOU TO BUBBLTAG, EXCLUDING PAYMENTS TO A HOST, DURING THE 12 MONTHS PRECEDING ACCRUAL OF THE CLAIM. THESE LIMITATIONS APPLY NOTWITHSTANDING FAILURE OF A REMEDY'S ESSENTIAL PURPOSE, SUBJECT ALWAYS TO APPLICABLE NON-EXCLUDABLE LAW.
To the fullest extent permitted by applicable law, you agree to defend, indemnify and hold harmless the Protected Parties against claims, liabilities, damages, losses, costs and expenses, including reasonable attorneys' fees, arising from or connected with your content, conduct within or outside the app, events, breach of these Terms, or infringement of law or third-party rights. For people to whom this section lawfully applies, this replaces the narrower limits in section 13. It is not to be read as transferring to you any liability that applicable law does not allow to be transferred.
To the extent permitted by applicable law, any claim must be brought within one year after it arises; otherwise it is permanently barred.
To the extent enforceable under applicable law, you and bubbltag may bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective or representative proceeding. Each party waives trial by jury to the extent that waiver is legally effective.
Subject to applicable non-excludable protections, these Terms are governed, for you, by Delaware law without regard to conflict-of-laws principles. The state and federal courts located in Delaware have exclusive jurisdiction, and you submit to them so far as that submission is enforceable.
If under 18, you confirm that your parent or guardian has read these Terms and agreed to them on your behalf. This confirmation is subject to the applicable rules on minors' capacity and on the legal effect of a parent's or guardian's agreement.
Your separate consent to a facial check is your written release for the collection and use of biometric information for the purposes described in the Privacy Policy, to the extent the legal requirements for such a release are met.
Certain states restrict or prohibit particular disclaimers, releases, limitations or waivers. Each provision of this section applies only to the extent permitted by the law that applies to you; nothing in this section makes a prohibited exclusion effective.
Under California Civil Code Section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone on (800) 952-5210.
This section applies to residents of a country within the European Economic Area.
The mandatory consumer protection law of your country of residence remains applicable and is not displaced by these Terms. You may bring proceedings in the courts of that country, and you keep the statutory guarantee of conformity that national law gives for digital services.
A ticket for an event on a specific date is a leisure service for a specific date; the 14-day right of withdrawal does not apply to it, to the extent the statutory exception is met.
Sections 5, 6, 12 and 13 operate to the fullest extent permitted by the law of your country.
